Terms of Service

These terms apply to the Essentially Amsterdam website at essentiallyamsterdam.com, our daily
email newsletter, and every service we offer through them. Please read them before using the site.
By using the site or subscribing to the newsletter, you agree to them.

1. Who we are

Essentially Amsterdam is published by PND Media, a business registered in the
Netherlands.

In these terms, “we”, “us” and “our” mean PND Media. “You” means anyone using the site or reading
the newsletter.

2. What we publish

Essentially Amsterdam is an independent daily publication for people living in Amsterdam. We
publish:

  • original news reporting about Amsterdam and the surrounding region;
  • listings of events, exhibitions, concerts and other things happening in the city;
  • a directory of local businesses and organisations;
  • a daily email newsletter drawing these together.

3. Editorial standards and corrections

We write our own articles. Where a story originates with another newsroom, we report it in our
own words and credit that publication as the source at the foot of the article.

We aim to be accurate. If we get something wrong, we will correct it. If you spot an error,
please write to info@essentiallyamsterdam.com
with a link to the article and we will look into it promptly. Substantive corrections are made to
the article itself.

Our editorial decisions - what we cover, what we leave out, how we describe it - are ours alone.
They are not for sale and are not influenced by advertisers, listed businesses or event organisers.

4. Accuracy of listings and event information

Event details change. Times move, venues change, performances sell out and things are cancelled
at short notice. We take reasonable care with the information we publish and, wherever possible, we
check dates and times against the venue’s or organiser’s own page.

Even so, please confirm the details with the venue or organiser before you travel or
buy a ticket.
We cannot accept responsibility for a journey made, a ticket bought or an
evening lost on the strength of a listing that turned out to be wrong or out of date.

5. Our content and your use of it

All content on the site and in the newsletter - articles, photographs, illustrations, listings,
the compilation of those listings, and the name and branding of Essentially Amsterdam - is owned by
PND Media or used under licence, and is protected by copyright and other intellectual property
laws.

You may: read, print and share our articles for your own personal,
non-commercial use, and quote short extracts with clear credit and a link back to the original
article.

You may not, without our written permission:

  • republish, redistribute or syndicate our articles, in whole or in substantial part;
  • copy our listings or directory data, or extract them into another product or database;
  • use automated means - scrapers, crawlers, bots - to harvest content from the site, other
    than search engines and news aggregators indexing us in the ordinary way;
  • use our content to train machine learning or artificial intelligence models;
  • use our name, logo or branding in a way that suggests we endorse you.

6. Third-party content and links

We link to venues, organisers, ticket sellers, other publications and other third-party sites.
Those sites are not ours. We do not control them, we are not responsible for their content, their
accuracy, their products or their privacy practices, and a link is not an endorsement.

Some images are used under Creative Commons or stock licences and are credited where the licence
requires it. If you believe we have used material of yours without the right to do so, see section
12 below.

7. Material you send us

You may send us news tips, event details, listings, corrections, photographs or other material,
including through any submission form on the site.

When you send us material you confirm that it is yours to send, or that you have permission to
send it, and that it does not infringe anyone else’s rights. You give us a non-exclusive,
royalty-free, worldwide licence to publish, edit, shorten and archive it in the newsletter, on the
site and in our social media channels. You keep ownership of what you send.

We are under no obligation to publish anything sent to us, and we may edit or remove it at any
time. Please do not send confidential information.

8. The newsletter

The newsletter is free. You can subscribe with your email address and unsubscribe at any time
using the link at the foot of every edition, or by writing to us. We do not sell subscriber lists.

How we handle your email address and other personal data is set out in our
Privacy Policy.

We may change the newsletter’s format, frequency or content, and we may suspend or stop
publishing it. We will tell subscribers if we stop.

9. Advertising, sponsorship and commercial content

We may carry advertising, sponsored placements and affiliate links, and we may charge businesses
to be featured in the directory. Any content that has been paid for is identified as such.

Paid placement does not buy editorial coverage, a favourable review, or influence over what we
report.

10. Acceptable use

You agree not to:

  • use the site for any unlawful purpose, or in breach of these terms;
  • attempt to gain unauthorised access to the site, its servers, or any connected system;
  • interfere with the site’s operation, including by placing an unreasonable load on it;
  • introduce malicious code, or attempt to circumvent any security measure;
  • submit anything unlawful, defamatory, abusive, deceptive, or infringing.

We may suspend or withdraw access to the site, or unsubscribe an address from the newsletter,
where these terms are broken.

11. No professional advice

Our content is general information and journalism. It is not legal, financial, medical, tax,
immigration or other professional advice, and you should not treat it as such. If you need advice
about your own situation, consult a suitably qualified professional.

12. Copyright complaints

We respect other people’s rights and we expect the same. If you believe material on the site
infringes your copyright, please write to
info@essentiallyamsterdam.com with:

  • a link to the page in question;
  • a description of the work you say has been infringed;
  • evidence of your ownership or authority to act;
  • your contact details.

We will investigate and, where a complaint is well founded, remove or credit the material
promptly.

13. Availability of the site

We try to keep the site and the newsletter available and working, but we do not guarantee that
they will be uninterrupted or error-free. We may change, suspend or withdraw any part of the
service, and we may restrict access for maintenance.

14. Our liability

Nothing in these terms limits or excludes our liability where it would be unlawful to do so. In
particular, we do not exclude liability for death or personal injury caused by our negligence, for
fraud or fraudulent misrepresentation, or for intent or deliberate recklessness on our part, and
nothing here affects your mandatory rights as a consumer under Dutch law.

Subject to that, and to the fullest extent permitted by law:

  • the site and the newsletter are provided as they are, without warranties of any kind;
  • we are not liable for indirect or consequential loss, loss of profit, loss of business, or
    loss of data arising from your use of the site or reliance on its content;
  • we are not liable for loss arising from inaccurate or out-of-date event or listing
    information, or from the acts of third parties whose sites we link to.

15. Indemnity

If you use the site in breach of these terms, or submit material you had no right to submit, you
agree to cover any reasonable losses, costs or claims we incur as a direct result.

16. Privacy and cookies

Our Privacy Policy explains what personal data we collect, why,
how long we keep it, and the rights you have under the General Data Protection Regulation. It forms
part of these terms.

17. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last
changed. If we make a significant change we will say so on the site or in the newsletter. Continuing
to use the site after a change means you accept the updated terms.

18. Governing law and jurisdiction

These terms, and any dispute arising out of them or out of your use of the site, are governed by
the law of the Netherlands. Disputes will be submitted to the competent court in Amsterdam, unless
mandatory law gives you the right to bring proceedings elsewhere.

If any part of these terms is found to be unenforceable, the rest continues to apply.
