Neighbours on the Elandsgracht in the Jordaan have complained for years about cooking smells from an Indian takeaway, and the dispute went to court on Thursday 15 October.
The takeaway’s exhaust pipe sits on the kitchen roof, directly below a neighbour’s balcony.
She says the smell gets into her bedroom, living room and clothes, so she keeps her windows shut in summer.
After dozens of reports, the municipality closed the takeaway in late September until 1 January 2027.
The two owners, who took over in February, are challenging the closure.
Proposed changes to the exhaust system
They told the court they have found new premises and want to move on 1 January, but cannot afford to stay shut until then with a debt of €28,000.
The municipality wants a new exhaust pipe two metres high instead of the current 85 centimetres, which needs a formal permit application with a six-week decision period.
It also suggested keeping the back door shut more often, preparing food elsewhere or using fewer spices.
The judge will rule two weeks after the hearing on whether the takeaway can reopen, and on what terms.
