Amsterdam Rent Increase Rules For Tenants In 2026

The 2026 rent increase caps are 4.1 per cent for social housing from 1 July, 6.1 per cent for middenhuur and 4.4 per cent for free-sector homes, the last two applying from 1 January.

Which one governs your flat is decided by its points score, not by the label in your contract.

A landlord cannot exceed the cap that applies to your segment, and in the free sector cannot exceed whatever your contract’s indexation clause allows if that is lower.

The 2026 Caps In Detail

Social and other regulated homes may rise by a maximum of 4.1 per cent, taking effect from 1 July, which is the standard date for the annual social-sector increase.

Income-dependent increases run alongside it: households on the lowest incomes are limited to a rise of €25 a month, while higher-income households in social housing can face a fixed increase of between €50 and €100.

Middenhuur homes are capped at 6.1 per cent, applying from 1 January, and the segment covers bare rents between €932.93 and €1,228.07 in 2026.

Free-sector homes are capped at 4.4 per cent from 1 January, or the percentage written into your lease if that is lower - the two are compared and the smaller figure wins.

The cap is applied to the bare rent, not to the total you transfer each month.

Service costs are adjusted separately and must be justified by an annual statement of actual expenditure, so an increase arriving as one blended number needs unpicking before you accept it.

Is Your Home Really Free Sector?

A contract describing your tenancy as liberalised proves nothing on its own, because segment is determined by the points a home scores under the woningwaarderingsstelsel.

Up to 143 points it is social, 144 to 186 is middenhuur, and only at 187 or more is it genuinely free sector.

Score it yourself using the calculator on the Huurcommissie site, which needs your floor measurements, energy label, kitchen and bathroom fittings and the property’s WOZ value.

Small flats with an older energy label frequently score lower than their asking rent implies, which is precisely the situation the reforms were written for.

If the score puts you in a regulated band, the lower cap applies from that point regardless of what you have been paying.

Depending on when your tenancy began, the starting rent itself may also be challengeable, which is a larger prize than the increase.

Checking The Notice

A valid increase notice is in writing and states the current bare rent, the new bare rent, the effective date and the basis for the calculation.

A WhatsApp message, a verbal mention at the door or a quietly amended standing order is not notice, and paying it does not make it one.

Timing matters as much as content.

Social-sector increases require at least two months’ written notice before the 1 July date, and free-sector and middenhuur increases must follow the date and mechanism set out in the contract.

Compare the old and new figures line by line, separating bare rent from each service item.

An increase pushed through the service-cost column rather than the rent column is the most common way a cap gets quietly exceeded.

Challenging An Increase

Object in writing before the increase takes effect, state that you do not accept it, and ask for the full calculation and the points score.

Keep the notice, your objection, your payment records and any reply, since a paper trail decides most of these cases without anyone reading an argument.

What Else Changes When Your Rent Goes Up

An increase can move you across a huurtoeslag threshold in either direction, so recheck your housing benefit position as soon as the new bare rent is fixed.

Some tenants gain eligibility they did not have; others lose it and never notice until the annual reconciliation.

If your rent crosses €932.93 or €1,228.07, your segment may have changed on paper without your home changing at all.

That is exactly the moment to score the points, because a landlord’s arithmetic is not the same thing as a legal reclassification.
